I don't think the difference really matters--being in a pool area is just as dangerous and two eight year olds should not be playing "near a pool" unsupervised. | I didn't mean playing near a real pool vs. swimming in it. I meant a real pool vs. a wading pool of one foot depth.
Of course, 8 year old girls have NO business having ANY unsupervised access to a real pool.

it was an above-ground pool. not a kiddie pool - you need a ladder to climb into it.

That shows such poor judgment I'd be hesitant to let my child go there again for a playdate.
