Job not paying - unemployment?

DH works for a non-profit that has been struggling to meet payroll for a few months already. We don't know if/when he will get his next paycheck. He is looking for another job but I am wondering if he can apply for unemployment benefits to help tide us over until he finds something else. He has not officially been fired but also hasn't been paid. Anyone have similar experience? TIA

In new york, sadly not. He can't apply for unemployment unless he's not working and able to work

I did it as did all my coworkers.Unless the law changed in the last few years.
