Yes, Sky, thanks for asking for clarification. I can understand your comments better now.
I will answer with a simple, yes, the prosecution side is from the govt. They are the ones formally 'accusing' the suspect based on the evidence and testimonies that they gathered in their investigation. Prosecutors don't like to lose, they don't like to be wrong, and since their reputation is at stake, they often don't waste their time on cases that seem too weak to stand up against cross-examination.
I was going to explain the process in detail, but I think this is clear enough. If you still aren't clear, ask again. I am off to Shabbat, but other imamothers are anyway more qualified to explain the legal process. |

I guess part of the problem with believing every case is that there are prosecutors who will go after cases that are shaky. I guess they give all other prosecutors a bad reputation so I don't think of the point that you are explaining. The story that comes to my mind is the one with the Duke players.

And then go back to your caves. | the police report was gibberish to me, all I see is the same 3 crimes duplicated 50 times each. I dont understand what that means. And I didnt HEAR THE TESTIMONY. So I have no evidence and no facts. We all have the same evidence and facts: He said, she said. Once the trial takes place and I actually read the testimony, there's a strong likelihood that I'll believe her! For now, I don't have any credible evidence from either side. All I know is what I've heard and I've read.
And I am NOT TAKING HIS SIDE, LADIES.... CALM DOWN. I am not taking any sides. I am being perfectly pareve. I'm saying, BOTH SIDES ARE INNOCENT UNTIL PROVEN GUILTY. He has been charged, not convicted. She hasnt had her day in court either. Until that day comes, both parties to me are equally in the right. Period.

While there is a slim chance that he may be innocent (unlike peacock who KNOWS that he is innocent)despite the conviction of the d.a. that he is guilty, we still need to treat him as guilty for the time being. He cannot be around any women whatsoever until we know the truth. He needs to be treated as a rapist, the fact that you don't know of the evidence doesn't mean anything. That information is surely known by the prosecutor.

Mama Bear, you cannot talk about how this girl is worldy, give the impression that she's lying and then say I'm getting out of this discussion. If you can't post now that's one thing, but I cannot stand when people say inflammatory comments and then say I won't be back on this thread. Either someone should be part of the discussion or not, but to leave a comment and run is cowardly. If that's not how you meant it I understand, but it's definitely how it came across.

MamaBear, the multiple instances of the same crime means the crime was committed on multiple occasions. So if, for example, I smashed your car window in, you got it repaired, I did it again, etc. etc. for say five or 10 times, the indictment against me would read the same crime five or 10 times.

Can you see saying that it is possible that someone did something wrong (made up a crime) would lead people to the logical inference that they actually did do something wrong. It's not twisting your words, it's a logical inference.
I'm in my 40s, didn't become frum until I was in my 20s, grew up totally secular and I couldn't make up a story like this, detailing abuse spanning over years, with details that would convince police and prosecutors who are trained in zexaul abuse and used to hearing the details of these crimes day in and day out. I couldn't stick to the same under multiple questionings and I fact-check documents for a living. I get paid well because I can remember that 2,000 words ago you said something that contradicts what you wrote 2,000 words later and I know I'm not capable of doing such at thing.
There is a big jump between "worldly" and able to and willing to perpetrate a long-running hoax in the face of the justice system designed to ferret out such a falsehood before a case is charged. Prosecutors can and do lose their jobs for not adequately checking out the stories of accusers. It makes the District Attorney look bad, and as elected officials (or appointed by elected officials), they can't afford that. Prosecutors have been disbarred (lost their license to practice law) for moving forward with allegations that fall apart in court. It doesn't happen often, but it does happen. Cases where the accused are almost certainly guilty don't get filed because the person making the accusation isn't a "credible witness," and the lawyers know they won't hold up in court.

I hear what youre all saying. I guess I was posting late at night and was in a hurry, and despite my "good English" that I get complimented on all the time (The dental hygieniest yesterday asked me if I'm a native of Wmsbg, and the xray tech asked me the same last month - lol), it's still perhaps not as natural as it is to those who speak it all the time, and I perhaps don't explain myself well all the time so that my words are misconstrued/misunderstood.
I reiterate that I am in neutral zone. I only come across as taking his side because only those of you who are on her side are taking me to task, so naturally I'm defending myself.

In many courts, children who have been molested are represented by Child Advocates, who help them get through the harrowing experience of testifying. I volunteered as a Child Advocate for several years as a young attorney.

Peacock- he did have ample time to defend himself, and he did exactly that. He is saying he is not guilty, just as she is saying he is. Noone has been to court yet, so the playing field is even right now.
Maybe you know something I don't know, if so please enlighten me- how do you know she's lying? I wish for her sake that she is (so it means she didn't actually endure the abuse), and I would love to know so I can sleep a little more peacefully tonight knowing that she is not hurting so much inside from the abuse.

Like someone with a profile - an age, a gender, a story? Until I don't hear it from a real, credible source, it's just empty words.

mama bear, I understand where you are coming from, and it is understandable to want to not believe any accusations against weberman. but I think you are trying too hard to try not to believe it, and I'll tell you what I mean: when you point a finger back at the girl, and say that she isn't so innocent and naive, well, first of all you are making accusations back at her. being dan lekaf zechus one person while making accusations at another kindof defeats the purpose, don't you think? second, your argument doesn't dispute the possibility that he abused her, because generally child molesters target not-so-innocent, troubled children. they are easier targets. a very well adjusted girl would not be a good candidate for the emotional manipulation that goes along with this type of abuse. so in addition to trying to paint the girl in a bad light in order not to believe her story (or the story of her real therapist) you are just giving us another detail in why weberman might have targeted her as his victim. if indeed he is guilty. it would be much harder for me to believe if you told me that she was the most innocent, well adjusted girl in wili, then I might say this new therapist has an agenda. but if she was as you describe her, then it makes more sense to me how she was targeted (allegedly) by weberman. it is another piece of the picture that makes her story more believable.

Would you send your daughter to him tomorrow for a session?
Instead of a fundraiser you should have people sign up their daughters for a private session with him and pay him his supposed rate (if that is true) instead. I think that would force people to really think about how they feel about the case.
Personally I wouldn't let my daughter anywhere near him even though I don't know details about the case.
