I was at a children's clothing store today. There are signed throughout the store "everything 70% off" and "all items final sale". I found a beautiful shabbos dress for my daughter. We don't usually spend much on clothing but at 70% off, I could afford the splurge.
I went to pay, and perhaps it was my fault for not looking at the pad for the total before entering my CC info but when I got the receipt I saw they charged me only 30% off. When I questions the sales lady, she brought over the store manager who mentioned that rack was only 30% off. There were no signs on the rack indicating it wasn't 70% off.
When I asked then if I can return the item as it is too expensive for me, they said because all store items are final sale.
I walked out feeling very down. I don't have a penny extra.
I realized maybe I should have fought more? I'm a very timid personality and this is difficult for me.

What would you have done? I'm all conflicted

I would have fought them. If they didn’t clearly label it 30% off then they need to let you return it. Also if it says everything 70% then it’s everything. If it was multiple sales it would say up to 70% off not everything 70% off.

If it wasn't clearly marked that that rack is 30% off, then I think they need to give it for 70% or let you return it. I'd go back to the store.

I would go back and take pictures of all the sale signs and if that unmarked rack and tell them it's false advertising and if they don't honor the full sale price or a return, you're going to chargeback the purchase.

As someone who works in this line, this is totally unacceptable! They either have to have that rack clearly marked or they have to take it back. Do they want people to find out that it's %30 off only after they paid and once they cannot return.

So many things wrong with this story!

If they said everything is 70% off, it means everything is 70% off.

And final sale doesn’t mean when you looked at the receipt and see they overcharged you! That’s just obnoxious!!!

Besides, if it’s not 70% off, it’s not final sale either.

I hope you go back and fight it or dispute the charge like others said.

I would call them again. If they still dig in your heels, then call the credit card company and dispute it. End of story out of your hands.

I would, however speak to my local Rav and ask him what his opinion would be. I believe these are the exact cases that call for choshen mishpat training that our Rabbanim review.

Of course you should’ve fought. They’re obligated to honor whatever sign is posted. If they refused,I’d have disputed the charge with my credit card company. Then you’d get a response from the store.

Was the person you spoke to an employee or the owner? Sometimes employees just follow the rules they are given, with no authority to change them.

If they were told, "Write on the sign everything 70% off" they would. And then, "Remember that the racks of new season merchandise is only 30% off," okay. And then "everything final sale and no returns," yes sir.

Whereas if you speak to the owner or a manager, they usually have the authority to say that the rule doesn't apply in your case, and either give you the full 70% off or allow you to return the product.

Are you sure the signs said “everything 70%off “. Or was it up to 70%?

I can totally imagine which store this happened in. I learned to always ask for final price before handing over payment. That way I can decide if it's worth it to me or not. Sometimes the original price is ridiculous and even with 70% off, it's still too expensive for me, so I have them do the calculation and then decide.

Ths sign probably said 70% off sale. It is tricky.
I know already to check price displayed before I swipe ( everyone should do it as a habit because mistakes happen.)

I am also timid in personality. One year as a young wife I was hosting my entire in law family for pesach (my in laws weren’t up to hosting that year), my mil gave me her credit card and told me to buy everything I needed. It was my first time making pesach, so I needed everything. I came into the store asking for x brand pots which were on sale. The sales lady told me to go with y brand bec they’re much better. I was buying so many things I didn’t stop to look at price of everything. When I got home I saw the receipt said I paid $600 for a set of pots and pans when the one I wanted originally was $200. This was not my money it was my in laws credit card. I went back to the store with the huge box of pots. They did not want to take it back, but I stood my ground most likely bec I didn’t know how I’d tell my mother in law I bought the most expensive set of pots accidentally! They yelled at me and told me I should never shop there again but they did accept the return.

I can relate to you and feel bad this happened to you!
