israel definately is not the easiest place to live, but it's the most beautiful country! the state however.....oh well, that's politics, and I am sure we don't have to get into that here.

and the rambam, whom we pasken according to when there is a machlokes, doesnot list it the mitzvahs that apply nowadays.

If it is a mitzvah that has to do with the now a days we don't necessarily pasken according to the Rambam. If it is something that has to do with the Beis HaMikdash or korbonos then we do generally pasken according to the Rambam.

This is applicable now a days. Many rabbonim hold that it is a saffek dorisa and then you have to pasken l'chumra which would mean living in Eretz Yisroel.

source please? afaik when it is an argument btw the rambam and one other rishon we pasken like rambam only don't pasken like him when there are all the other rishonim arguing with him.
