I got this email:
Why We Can't Comment
Thank you for signing the petition "Call an
Investigation into Allegations of Prosecutorial &
Judicial Misconduct in the Case of Sholom
Rubashkin." We appreciate your participation in the
We the People platform on WhiteHouse.gov.
As explained in the We the People Terms of
Participation, the White House may at times decline
to comment on certain specific matters properly
within the jurisdiction of federal departments or
agencies, federal courts, or state and local
governments in its response to a petition. For
important policy reasons, this includes specific law
enforcement and judicial ethics matters. With
respect to law enforcement matters, the Department
of Justice is charged with investigating crime and
enforcing our laws. The Department also has
mechanisms in place to investigate allegations of
prosecutorial misconduct, including through its
Office of Professional Responsibility. With respect
to judicial ethics matters, the Judicial Conduct and
Disability Act of 1980 vests primary responsibility
for investigating and adjudicating claims of judicial
misconduct with the Judicial Branch.
This petition calls for an investigation into
allegations of prosecutorial and judicial misconduct
in the case of Sholom Rubashkin and for action to
correct the “gross injustice” in his case. For the
reasons given above, the White House declines to
comment on matters raised by this petition.

I got that email too. I think it just means that it "Cant comment" not that they're not doing anything about it. I guess we'll see if our actions get rewarded.

Actually, the way I'm reading it is that this is not the avenue that is going to bring S. Rubashkin's release (not that they are doing something but cannot talk about it).

There was a disclaimer as such on the site the whole time, I believe.

It was mentioned a few times on one or more of the threads asking people to sign the petition that they would not intervene in a case like his.

Huh? Obama dangled change? By what, saying that the White House would look at petitions? That's not a promise to actually do whatever the petition is requesting. Read the response:

Anybody who read the site before starting the petition would have known that this outcome (not commenting on this matter) was the most likely one.

(Actaully, I don't get this whole white house petition thing. I'd like to see a single piece of legislation that comes out of it.)

As far as I understand, one of the basic tenets of democracy is the non-interference of the government with the judiciary - The only exception being presidential pardons. So I really don't see how it could have ever worked.

I agree. Otherwise we'd be living in a country where the executive branch had control over the judiciary. In other words, Russia. No thanks.

To reiterate my last post, that email is NOT saying "Thanks for your petition, we can't do anything so go away." It IS saying "Thank you for your petition, Judicial matters are very sensitive, we may or may not do anything about it, but we can't tell you why or why not we choose to do what we do. Thank you and have a good day." Again it's hishtadlus. This case is drawing attention from big lawyers and congressmen who are also interested in an investigation. This petition is simply making the white house aware that A LOT of common people are interested in it also. That's the point of democracy.

I don't know where you are getting the 'may or may not' part from. To me it is pretty clear that the email is saying that the White house does not (and will not) interfere in judicial matters. I still do not understand what the point of petitioning the White house is. Theoretically speaking, let's say Obama did care. What could he actually do?

It's not saying it won't interfere with Judicial matters, it says it is "declining to comment" I copied from the email.
